The Supreme Court Refresher: "Call Us After You Finish the Game"

In a breathtaking display of judicial serenity, the Supreme Court has officially dismissed petitions challenging the Senate Impeachment Court’s revised voting threshold, declaring the legal firestorm "premature and not yet justiciable."

Translating decades of high-level constitutional doctrine into plain English, the High Tribunal essentially told eager litigants: "Guys, the basketball game is still in the 3rd quarter. Stop asking us to review the referee's call on a foul before the final buzzer rings!"

A. [ WHAT THE PETITIONERS WANTED ]

• "Stop the trial right now!"

[ WHAT THE SUPREME COURT SAID ]

• "Not yet justiciable."

B. [ WHAT THE PETITIONERS WANTED ]

• "Fix the denominator immediately!"

[ WHAT THE SUPREME COURT SAID ]

• "Premature. Let them finish first."

C. [ WHAT THE PETITIONERS WANTED ]

• "Issue a Temporary Restraining Order!"

[ WHAT THE SUPREME COURT SAID ]

• "Balik kayo kapag may pinal na hatol na!"

When the Senate Impeachment Court voted to adjust the $2/3$ conviction threshold by shrinking the denominator to cover only available, participating members, lawyers rushed to Padre Faura faster than a GrabCar driver during a rainstorm.

They expected high-voltage judicial drama. Instead, they received the ultimate legal equivalent of: "Mas mabuti kung hintayin muna ang pinal na pasya..."

(Translation: "Please let the Senate finish their own reality show before coming to our office.")

THE SUPREME COURT'S CHECKS & BALANCES

Step 1: Senate plays with basic arithmetic.

Step 2: Litigants panic and file urgent TRO.

Step 3: SC drinks tea, looks at calendar, and says: "Is the trial done? No? Then goodbye!"

By declaring the issue non-justiciable at this stage, the High Court gave everyone a masterclass in judicial efficiency. Why waste 500 pages writing an opinion on hypothetical math when you can simply tell everyone to come back after the verdict?

Naturally, the Senate Impeachment Court welcomed the Supreme Court’s decision with open arms and glowing press releases.

[ THE REACTION MATRIX ]

SUPREME COURT JUNKS PETITIONS FOR BEING PREMATURE
│
▼
SENATE IMPEACHMENT COURT:
"We welcome this decision! We always said it was premature!"
│
▼
TRANSLATION:
"Thank goodness! We get to keep using our custom calculator for a few more weeks!"

A. LITIGANTS' EXPECTATION
• Pause the trial mid-sentence to debate math.

THE ACTUAL PROCEDURE
• Senate keeps voting.

B. LITIGANTS' EXPECTATION
• SC becomes the live co-referee of the Senate.

THE ACTUAL PROCEDURE
• SC sits back, eats popcorn, waits for final appeal

C. LITIGANTS' EXPECTATION
Instant judicial intervention.

THE ACTUAL PROCEDURE
• Sorry folks ... maghintay kayo.

The beauty of the Supreme Court's "premature" dismissal is that it isn't a "No"—it's a "Not Yet."

It leaves the door wide open for the inevitable post-trial sequel.

If Vice President Sara Duterte is acquitted: The prosecution goes home, and the petitions remain moot.

If Vice President Sara Duterte is convicted under the new threshold: The defense immediately rides a speedboat back to Padre Faura shouting, "Okay, the game is over! NOW can you look at the denominator?!"

The Supreme Court’s message to the nation is delightfully simple: Let the constitutional process run its course.

Don't interrupt the impeachment court while they are drafting custom fractions, debating Zoom attendance from jail cells, or redefining the laws of arithmetic. Let them finish the entire performance first.

Because in Philippine legal theater, you don't review the play during the intermission —you wait for the curtain call, then you read the 100-page dissent!
